The main requirements for a Prospective Marriage or Partner Visa include being in a genuine and ongoing relationship with an Australian Citizen, Australian permanent resident or eligible NZ citizen. You should be engaged, married or in a defacto relationship and need to evidence other aspects of your relationship such as financial aspects, social aspects, nature of household and nature of commitment to each other. Other factors such as health, character history, no further stay conditions and previous visa refusals and cancellations are also considered. Individual processing times for a temporary partner visa (subclass 820/309) application may vary depending on a range of factors including the complexity of your case, completeness of your application and the volume of applications the Department of Home Affairs is reviewing at that time. 

The minimum assessment time for a permanent partner visa (subclass 801/100) is from the date of eligibility (approximately 2 years after the 820/309 application is first lodged).

Yes, the Partner Visa allows you to live, study and work in Australia. You will also have access to Medicare, Australia's healthcare system.

Yes, dependent children can be included in your Partner Visa application. Each child will need to meet certain requirements, including age restrictions and dependency status. Please note that additional charges may apply for each child included in your application.

It is possible to lodge your own visa application without the assistance of a migration professional if your circumstances deem a straight-forward application after consulting with us. However, we would strongly recommend seeking the help of a migration professional if your case presents complex issues. Partner visas are costly applications and present a high risk of refusal if applicants are not able to provide all of the required evidence and meet all visa criteria.

It is common misconception amongst couples that getting married is a requirement for the grant of a Partner Visa. This is not so as the primary requirement is to prove to the Department of Home Affairs that you are in a genuine and ongoing relationship. Couples need to be either be married or in a defacto relationship for 12 months prior to applying unless they register their relationship in a prescribed Australian state or territory legislation. Couples also need to evidence other aspects of their relationship such as financial aspects, social aspects, nature of household and nature of commitment to each other.

The costs of each type of partner visa may vary based on individual circumstances and Loved Up Migration will advise on all fees involved in applying for a partner visa in advance.

Typically the fees involved in applying for a visa include;
- Visa Application Charge set by the Department of Home Affairs 
- Criminal History Checks / Police Clearances
- Visa Medical/Health Check
- Document Translations (if applicable)

Registered Migration Agents (RMAs) are qualified professionals who possess knowledge and experience in Australian Migration Law and are able to legally provide immigration and visa advice in Australia. RMAs are regulated by the Office of the Migration Agents Registration Authority (OMARA) and must adhere to the Code of Conduct

Specifically, RMAs are able to;

  • Identify issues which may affect the success of the visa application
  • Advise on the best possible options in with migration law and policy
  • Liaise with the Department of Home Affairs and other authorities on behalf of clients.

Providing the required level of evidence and accurate information to support your visa application plays a very important role in the success of a visa outcome. Not only does it evidence your circumstances (i.e. the genuineness of a relationship for a partner visa) but it ensures that you are not providing any fake or fraudulent information to DHA that may impact on the grant of your visa application and end in a visa refusal or cancellation).

Loved Up Migration can assist clients to lodge decision ready applications to facilitate timely assessment by Home Affairs (DHA). However, we are not affiliated with DHA and therefore cannot influence processing times or guarantee visa outcomes. As processing times differ for each visa type, clients will be advised of the average assessment time and kept informed of the progress of their application at every stage.

1. 2. Loved Up Migration will assess your information and advise you on whether you may qualify for any partner visa pathways.

3. Once satisfied that you meet the criteria for a partner visa, an estimate for services and fees will be sent for your consideration.

4. Loved Up Migration will send a client agreement to be signed if the estimate for services and fees has been accepted by the prospective client.

5. Clients will be kept informed at every stage of the visa application process and are able to login to their own client portal to send and receive documents and information regarding the progress of their application.

Unlike some agencies we don't offer a free 15min consultation as we believe this is not the best value of anyone's time and won't set you up for success. We want to take the time to understand your relationship circumstances so that we can provide you the right advice using our expert knowledge.

Like the quote "nothing of value is free" think of a visa consultation as the paid peace of mind you have in knowing you have obtained professional advice before you commence the expensive partner visa process. 

We don't offer No Visa No Fee arrangements like some agencies as this does not reflect how we operate our practice.

Partner visa assessments are not black and white and the evidence required and assessed by the department can be quite subjective.

We set reasonable professional fees based on the complexity of your case, the work involved and our skills and experience without employing any schemes to attract business.
